Sivasupramanium Thilairaj(aged 40) of Vairavar Kovilady, Manipay, was arrested by the army on 2011 June 10th at Manipay, accusing him of attacking a Sri Lankan Air Force Aircraft with a missile in 1999 at Kompady, Elephant Pass,causing the deaths of 4 Air Force men, including Officer Diron Delmon Susantha and was handed over to the TID.
On the basis of a confession he gave to an ASP while he was detained at the Boosa Detention camp, a case was filed against him during the early part of 2016 in the High Court, Jaffna. When the charge sheet was read to him on 26th April 2016 and moved to be annexed to the case file, the attorney for the accused Mudiyappu Remidius objected to it that his client had not given the confession voluntarily but under the torture and assault of the TID, and as his client is not aware of what is in the confession submitted, which is in Sinhala language and that the confession could not be taken as a legitimate evidence against his client.
After the judge rejected the confession, the prosecutor asked for time to analyze whether any other evidence are available against the accused. However when the case was resumed yesterday, he said that no other evidence is available.
In this context the judge acquitted the accused from the case.
However the released accused was further remanded as he had been charged in another case of shooting down a “Lion Air” plane at Iranaitheevu, killing 55 public in 1998 is in progress now.
