Abrew’s FR refused

The fundamental rights violation petition filed by retired Supreme Court Judge, Sarath de Abrew indicted in the High Court of Colombo for sexual abuse and assault of a female domestic servant around June 2015 at his residence was refused by Supreme Court. Supreme Court held that the Attorney General had neither acted arbitrarily nor exceeded his powers in indicting Abrew. The AG had acted justifiably.

Additional Solicitor General Yasantha Godagoda with Senior State Counsel Janaka Bandara appeared for the Attorney General. President’s Counsel Manohara de Silva appeared with President’s Counsel Uditha Egalahewa for the petitioner. Counsel J. C. Weliamuna appeared with Pulasthi Hewamanna for the aggrieved domestic aide.

The Bench comprised Chief Justice K. Sripavan, Justice Priyantha Jayawardena and Justice Upali Abeyratne.
