Mulaitheevu Magistrate court rejected yesterday an application for calling Major General as witness in the habeas Corpus for the persons who went missing after being handed over to the Army.
Several including the LTTE’s Political Leader for Trincomalee, Ezhilan were handed to the Army by their relatives at the end of the war and were made to disappear. The relatives of some of them filed a habeas corpus at the Vavuniya High Court earlier.
The Vavuniya HIGH court ordered the Mulaitheevu Magistrate court to inquire the case and file a report. Accordingly a case is in progress in the Mulaitheevu Magistrate Court. The case was taken up for hearing yesterday.
When the case was taken up for hearing on March 30th, the AsAL of the petitioners applied for an order for Maj. Gen. Shavendra Silva who fought in the final war as the Commander of the 58 Division be called as a witness.
The court while dismissing the application saying that a person who has not been named as a respondent cannot be called as witness and postponed the case to 29th of June.
