Justice Wijeyawardene resigns from the trial on Dr. Kumaravadivel Guruparan’s appeal

It is my position that the intellectuals from the Legal sector should be allowed appear in courts and practice Law. It will be appropriate to the intellectuals of the legal sector. I have expressed at various opportunities. Hence I resign from the sitting that is hearing this appeal, announced, High Court Judge Justice Priyantha Jayawardena.

The case was put away to July 16th, so as to appoint a three-member panel to hear the case.

Dr. Kumaravadivel Guruparan had filed this appeal against the University Grants Commission’s ruling that the Attorney at Law employed in the legal sector cannot appear in court cases and the decision taken against him appearing in court cases by the Council of the University of Jaffna.

41 respondents had been annexed in this case including the UGC, members of the Council of University of Jaffna and the Attorney General. Attorney at Law Mohan Balendra filed this appeal on behalf of Dr. Kumaravadivel Kuruparan, at the High Courts on17/12/2019.

Earlier, Justice S.Thurairajah also declined hearing the case on the grounds that he is an acquaintance of Dr. K.Kuruparan.

Presidents Counsel, Rumes de Silva submitted that this appeal had been filed to defame the country.

President’s Counsel Kanaga Eeswaran strongly denying his statement said they are not trying to politicize this case and that he is condemning the attempts to politicize it.

It is notable that the said ban was proclaimed after Dr. Guparan appeared for writs and habeas corpus for persons arrested by the Army and later made to disappear.
