Sumanthiran’s Junior in an effort to nullify the powers of the Northern Provincial Council through Sri Lanka Courts

Niran Anketell, the Junior Attorney at Law of , M.A.Sumanthiran , the spokesman of TNA and Attorney at Law, had undertaken a vigorous attempt to nullify the meager powers granted to Northern Provincial Council by 13th amendment, through the Sri Lankan courts.

Severe disappointment, doubts and anger have been caused among the Tamil Politicians Nationalists, Activists and general Tamil Public by information that has begin to seep regarding this  intrigue undertaken through the Appeal court.

It has been learnt that:

The Appeal Court recently took up the Writ application filed by Ex- NPC Minister  P.Deneeswaran for a primary hearing. AAL Suren Fernando appeared for Ex-Minister Deneeswaran and Senior President’s Counsel Kanag-Isvaran appeared for 1st Respondent, Chief Minister C.V.Wigneswaran. AAL Niran Anketell appeared for Ex-Minister, Dr.Sathiyalingam.

It was discussed in the Appeal Court whether to issue notice on the Respondents, or issue an interim injunction . AAL Niran Anketell  argued that, under the 13th amendment, the powers to appoint Ministers and remove Ministers rest with the Governor and that the Chief Minister has no such power.  AAL Suren Fernando also placed the same argument and said that the Chief has not been given any power legally and hence the Chief Minister has no right to remove his client, Ex-Minister Sathiyalingam from the post.

Senior President’s Council, Kanag-Isvaran  who appeared for the Chief Minister argued that 13th Amendment is a part of the Political Constitution and that only the Supreme Court has the power to investigate any provisions of the Constitution and the Appeal Court does not have that right. He further said that the Governor accepting the recommendation of the CM and appointing Ministers as per CM’s request had made the arguments of the AALs of the Petitioners baseless.

Those who were saying all these days that adequate powers could be devolved to Tamil people through 13th Amendment had now risen up to argue that the CM has no power to appoint or remove Ministers and that only the Governor has that power.

It is notable that, AAL, Niran Anketell is a Junior AAL of President’s Counsel M.A.Sumanthiran.

The court announced that the decision of the Court as to whether to issue a notice on the Respondents or to issue an Interim Injunction will be delivered on 3rd of October and adjourned the Court.
