Torture in custody at Chunnakam Police case – Bail application of accused police officers  rejected

The bail application filed by 5 former police officers including former OIC of Chunnakam Police Station Chinthakka Bandara, who had been sentenced to 10 years rigorous imprisonment for torturing an arrested suspect  while in their custody has been again rejected by Jaffna High Court.

On 2011.11.25, 5 persons including S.Sumanan were arrested. While he was being taken to Vaddakadchchi, Kilinochchi for inquiries on 26/11/2011. The police informed the Kilinochchi court that Sumanan escaped from police custody and committed suicide in the Iranaimadu Tank.

However during a case against the other 4 suspects, two of them testified that 8 police officers including the OIC, Chinthaka Bandara tortured Sumanan to death at Chunnakam Police station. On the orders of the court, inquiries were pursued  by the CID,  5 Police officers including Chinthaka Bandara were charged by them with murder of Sumanan at the KIlinochchi Court.

Further,  a torture case was filed against 8 police officers including Chinthaka Bandara  at the Jaffna HC, by the AG Department. 6 officers including Chinthaka Bandara were sentenced to 10 years RI. But only 5 were jailed as the 6th officer had escaped abroad. All 5 convicted officers had filed an appeal against their punishment.

Later they had filed an application for bail as their appeal is being heard at the Appeal court. The AG department AAL Nagaratnam Nishanth objected granting bail as it will hinder the charge sheet to be filed against the convicted prisoners in the Jaffna HC in the Murder case, and citing other reasons.

After examining his submissions, HC Judge Illancheliyan rejected the application.

It is notable that last year also the 5 convicted prisoners applied for bail and that application also was rejected.
