Writ of Mandamus: Army did not submit details of surrendered persons as ordered
Although 58D officers agreed to submit the details of people who surrendered to the Army yesterday to the Mullaitheevu Court, the details were not submitted yesterday as the government Attorneys were not present in the court the case was postponed to May 17th.
On February 17th, Mullaitheevu Judge, M.S.M.Samsudeen ordered the Commanding Officer of 58D to submit the above list .
A writ of Mandamus was filed at Vavuniya Court regarding people who went missing after surrendering to the army and the case was later transferred to Mullaitheevu Courts. When the recording of witnesses, on the last Dcember 10th, the Commanding Officer of 58D testified that the names of the persons set in the mandamus had not surrendered to the Army. Thereupon the Attorney for affected persons, K.N.Ratvel asked him on what grounds he is saying this.
The witness replied that there is a list of persons surrendered to the Army and that he checked with it and the said names in the Mandamus are not in it.
Thereupon the Attorney requested the court that the said list be submitted to court. Although the Government Attorneys objected asking one their witness to submit evidence, Ratnavel argued that, the affair of the missing persons is internationalized matter and the list is an important material and should be submitted in the courts. The judge over ruled the objection and asked the CO to submit the list in court
