Arrest of students will disturb the University Community which is recovering from War environment, argues AAL Guruparan

The arrest without following legal provisions of University students will disturb the University Community, argued the Head of Law Department and the AAL appearing on behalf of the arrested students, K.Guruparan.

In a context where the Sri Lankan Government has acceded the 30(1) Resolution of the UNHRC that crimes were in Sri Lanka,  even before 10 years, there is no provision  in PTA, or in its sub provisions or in the emergency law for arresting people for keeping photographs of public killed in war including that of Isaipriya, he argued.

Further he argued that the emergency law was activated to arrest people connected to Easter Sunday bombing,  not people connected with incidents of war ending in 2009. As per section 7(1) of PTA only an SP is authorized to sign case documents. Since, Kopay OIC does not have the jurisdiction to sign case documents, and hence, the case is filed without legal base and the case should be dismissed.

After hearing the arguments the Magistrate put off the case till today.
