Accused in attack on Elephant Pass Army camp, acquitted by Jaffna High Court

Poonkuyil alias Fernando Emilthas ( aged 36) , a former member of the Intelligence unit of the LTTE, who was accused of being a member of the LTTE’s “ Oyatha Alaikal 3 ” assault team and attacking the Elephant Pass Army camp was acquitted by Justice Ilancheliyan for want of evidence except his confession which was rejected as unreliable quoting a judgment delivered by  a Supreme Court bench comprising Justices C.V.Wigneswaran , Ameer Ismail and Mark Fernando  in a case against Nagamany Theivendran.

In his judgement  the Judge said the prosecution had failed to submit adequate submission to show that the accused really attacked the Elephant pass Army Camp on 22nd and 23 rd of April 2000,  or the Camp was attacked on these dates and no further inquiries had been made beyond the confession by inquiring Officer Abdeen or the Woman ASP, Pathmini who recorded the confession.

The Judge also said in courts that, this is the last case under PTA before his court..
