Did the Governor go beyond his authority limit? Court asks the Governor to explain
The High Court Judge, M.Ilancheliyan ordered the Governor to explain whether he went beyond the limits of his powers.
The Northern Province Additional Director of Education M. Jegu had filed a writ of Quo Warranto saying that the NP Governor had taken a decision contravening the Law.
The above order was proclaimed by the judge when the above case was taken up for hearing yesterday.
The Additional Director of Education had proceeded to Australia on a scholarship to undertake a post graduate study in 2016 after obtaining necessary approval. He left the country on 30th September after receiving the approval Chief Secretary on September 28th.
In this Instruction were sent by the Governor’s Secretary, through the Australian Government to return to the country.
The said officer had filed a writ saying that an injustice had been caused to him and inquire about it. AsAL Varatharajah and Mehala who appeared for the Respondent argued that the plaintiff had gone without proper approval and he had been called back for facing the disciplinary inquiry against him.
AAL Kuruparan argued that evidences of proper approval could be submitted and this action of the Provincial Authorities will affect the scholarship chances of state officers.
After hearing the arguments the judge adjourned the case to the 26th.
