Sumanthiran’s bid to de-stabilize NPC fails, Case against the Chief Minister dismissed by Appeal Court
The case filed by former NPC Transport Minister, Deneeswaran in the Appeal court was dismissed yesterday. The said case which is in progress from September last year, was taken up for hearing yesterday before Justice Dehideniya and Justice Amarasekara.
The judges dismissed the case with cost, in the absence of the CM citing that there are no legal reasons to conduct the case further.
Deneeswaran submitted that the CM has no authority to remove him from the post of Minister and only the Governor has that power. Further he boasted at that time, if Wickeswaran is a justice, he is a an attorney at Law and that he knows how to handle the case.
AAL Suren Fernado appeared on behalf of Ex-Minister, Deneeswaran and AAL Niran Anketell and President’s Counsel M.A. Sumanthiran appeared on behalf of Ex-Minister while, Senior President’s Counsel Kanag-Isvaran assisted by AAL Mohan Balendra and AAL Jeyakkumar appeared on behalf of CM. The AALs of the appellant had argued that the CM has no power to dismiss a Minister and only the Governor has that power. It is this argument that was rejected by the Judges of the Appeal Court.
